Getting started

What are mineral rights and royalties?

Mineral rights represent ownership of the oil, natural gas, and other minerals beneath a tract of land. Royalties are the income generated from that ownership when oil or natural gas is produced. Royalty payments are made by the operator, and mineral owners do not bear the costs of drilling, operating, or maintaining the wells.

How do I get started?

What documentation do I receive when I purchase mineral or royalty interests?

With Heritage, ownership is conveyed by a recorded mineral deed filed in the county where the property is located. Once recorded, your ownership becomes a publicly documented real property interest. We also provide copies of the recorded deed and supporting closing documents for your records.

Owning royalties & income

What is the risk of owning mineral and royalty interests?

Royalty income is influenced by oil and natural gas production, commodity prices, and ongoing development activity, all of which can change over time. While established production history can provide a stronger basis for evaluating a property, future income is variable and cannot be guaranteed.

Once I own mineral and royalty interests, are there any ongoing expenses, management fees, or maintenance?

Mineral and royalty owners do not pay drilling, operating, or maintenance costs. Those expenses are the responsibility of the operator and the working interest owners.

How is my royalty income calculated?

Your royalty income is based on your ownership interest, the amount of oil and natural gas the well produces, and the prices received for those commodities. Because production and commodity prices change over time, monthly royalty income will vary.

Will my income be the same every month?

Royalty income changes over time as well production naturally declines, commodity prices fluctuate, and new development occurs. Some months may be higher than others, and future royalty income is not guaranteed.

How soon do royalty payments begin after purchase?

The timing depends on the operator's transfer process and payment cycle. Heritage coordinates the ownership transfer and works with the operator throughout the process. Once the transfer is complete, royalty payments typically begin within a few months, although timing varies by operator.

Where does my royalty income come from, and how often is it paid?

When oil and natural gas are produced and sold, the operating company distributes royalty payments directly to the mineral owner. Royalty payments are typically made monthly.

Taxes & 1031 exchange

Are there tax advantages to owning mineral and royalty interests?

Mineral and royalty ownership may provide certain tax advantages, including percentage depletion deductions and, in some situations, the ability to defer capital gains taxes through a Section 1031 like-kind exchange. Because every situation is different, we recommend consulting your tax advisor regarding your specific circumstances.

What is the depletion deduction?

The percentage depletion deduction recognizes that oil and natural gas are finite natural resources. It allows many mineral and royalty owners to deduct a portion of their qualifying royalty income, which may reduce their taxable income. Because eligibility and tax treatment vary, we recommend consulting your tax advisor regarding your specific circumstances.

Can I hold mineral and royalty interests in a self-directed IRA?

Yes. Mineral and royalty interests can be held in many self-directed IRAs, subject to the policies of your custodian and applicable tax rules. Heritage works directly with self-directed IRA custodians throughout the acquisition process. We recommend confirming your account's eligibility and any applicable requirements with your custodian and tax advisor.

Who handles a Section 1031 exchange?

Heritage will work with you throughout the exchange process and coordinate with your qualified intermediary, who prepares the required documentation and facilitates the exchange. If you already have a qualified intermediary, we're happy to work with them. If not, we can introduce you to several experienced professionals we've worked with over the years.

How long does the Section 1031 exchange process take?

The timing depends on your transaction, but IRS rules generally require you to identify your replacement property within 45 calendar days of selling your relinquished property and complete the exchange within 180 calendar days. Heritage works closely with your qualified intermediary to help keep the process moving. We recommend working with your qualified intermediary and tax advisor to ensure all IRS requirements are met.

Can I sell my mineral and royalty interests later?

Yes. Mineral and royalty interests can be sold at any time. Heritage can assist owners who wish to sell by helping market their interests to qualified buyers. The timing and sale price will depend on market conditions, production, and buyer demand at the time of sale.

How do you determine an offer for my mineral rights?

Every property is evaluated individually. We consider factors such as production history, location, title, current and future development activity, operator quality, and current market conditions. Our goal is to provide a fair, competitive offer based on the property's long-term value.

Who would I sell my mineral and royalty interests to?
